These Terms of Use (“Terms”) govern use of the Sospita Risk Assessment application (“App”), provided by SOSPITA YAZILIM LIMITED ŞİRKETİ (“Sospita”, “we”, “us”, or “our”). By using the App, you agree to these Terms.
1. Nature of the App
Sospita Risk Assessment is a local-first professional risk-assessment application. No Sospita account is required for normal use. Assessment data is stored primarily on the user’s device unless the user deliberately exports or shares it through an available function.
2. Professional Responsibility
The App assists users in structuring and documenting risk assessments. It does not perform the professional assessment on behalf of the user. Users remain responsible for identifying hazards, defining scenarios, selecting the appropriate assessment method, assessing likelihood and consequences, selecting and evaluating controls, determining residual risk, deciding whether risk is acceptable, and complying with applicable laws, standards and organisational requirements. The App may calculate scores based on user-entered values. A calculated score does not constitute professional approval or confirmation that the assessment is adequate.
3. Risk-Assessment Methods
The App may provide methods including risk matrices, Fine-Kinney and FMEA. Users are responsible for selecting the methodology appropriate to their activity and for correctly interpreting the results.
4. Templates
Sospita may provide built-in or premium templates as starting points. Templates are not guaranteed to identify every hazard, address every applicable law or standard, suit every workplace or activity, or replace a site-specific assessment. Users must review and adapt templates to actual conditions.
5. Local Data and Backups
Assessment information is stored locally on the device unless the user deliberately exports or shares it. Device loss, corruption, reset, migration failure or uninstalling the App may result in permanent loss of local data. Where backup functionality is available, the user is responsible for creating backups and storing them securely. Backup files may contain sensitive workplace information and should be protected appropriately.
6. Signatures and Approval Fields
The App may permit drawn signatures, signature images and Prepared/Checked/Approved-by information. These features are intended for documentation and workflow purposes and are not represented as qualified, cryptographic or legally certified electronic signatures.
7. Free and Pro Features
The App may include free functionality and optional Pro subscriptions. Pro functionality may include additional matrices, unlimited assessments, branding, premium templates, custom methods or additional export capabilities. Current features and entitlements are those displayed in the App at the time of purchase or use.
8. Store Subscriptions
Subscriptions purchased through the Apple App Store or Google Play may renew automatically according to the relevant store terms. Users may manage or cancel subscriptions through the applicable store account. Refund requests for store purchases are generally handled under the applicable store’s rules and mandatory law. Sospita does not receive the user’s full payment-card information for purchases handled by those stores.
9. Subscription Expiry
Where supported by the App, existing assessments may remain readable or exportable after Pro access expires, even though creation or editing of Pro functionality may become unavailable.
10. No Guarantee of Safety, Compliance or Outcome
Sospita does not guarantee that use of the App will identify every hazard, prevent an incident, make a workplace safe, guarantee compliance with law, regulation, standards or customer requirements, satisfy a regulator, auditor, insurer or client, or make a user-entered assessment professionally adequate. Professional judgement remains with the user.
11. Intellectual Property
Sospita retains all rights in the App software, supplied templates, system content, user interface, documentation, trademarks and other Sospita intellectual property. Users retain rights in their own assessments, photos, signatures, logos and other content they create.
12. Availability
The App is designed for local use, but certain services such as subscription validation may depend on third-party services or network connectivity. Sospita does not guarantee that every feature will always be available without interruption.
13. Liability
To the maximum extent permitted by law, Sospita will not be liable for indirect, consequential or special losses resulting from professional decisions made using the App. Nothing in these Terms excludes or limits rights or liabilities that cannot lawfully be excluded, including mandatory consumer-protection rights.
14. Privacy
The Sospita Software Privacy Policy explains how Sospita handles information in connection with its products. Information that remains solely on the user’s device is not received by Sospita unless the user deliberately transmits it through an online, support, export or other enabled feature.
15. Consumer Rights
Nothing in these Terms excludes or limits mandatory rights available to consumers under Turkish law or other applicable law.
16. Governing Law
These Terms are governed by the laws of Türkiye, subject to mandatory consumer-protection and forum rights.
